1.The service#
BrandMuse helps brands and creators work together. Depending on your plan and settings, it lets you create a brand profile, find and evaluate creators, send offers and messages, negotiate, sign contracts, record payments to creators, review content and ad disclosures, and report on results.
When you connect them, BrandMuse also works with third-party platforms such as TikTok Shop, TikTok ads, TikTok, Instagram and YouTube — for example, to show sales and affiliate performance, manage affiliate creators, handle sample requests, send creator messages or show ad results. Available features may differ by plan, by country and by what each platform allows.
BrandMuse is a platform. Collaboration agreements are made between brands and creators. We are not an agency, an employer of creators, or a party to those agreements, and we do not hold or send money between brands and creators.
2.Accounts#
- You must be at least 14 years old and able to make a binding contract where you live. If you are a minor under your local law, you need your parent or guardian's consent to accept paid collaborations.
- Give accurate information and keep it up to date.
- Keep your password safe. You are responsible for activity on your account. Tell us right away if you notice unauthorized use.
- Each account is for one person. Workspace owners decide who joins their workspace and are responsible for their team's use of it.
3.Brand responsibilities#
- Describe your brand, products and verification details truthfully.
- Make honest offers: state the fee, deliverables, usage rights and deadlines clearly.
- Review submissions within the deadline you promised, and pay creators directly as agreed. BrandMuse does not hold or send this money.
- Follow advertising and disclosure laws in each market, such as those of the US FTC and Korea's KFTC. BrandMuse's disclosure checks help you, but they are not legal advice.
- Respect creators' choices: stop contacting creators who decline or opt out.
- You are responsible for messages sent in your brand's name, including AI-drafted messages that you approve or that are sent by automations you turn on.
- Ship products and pay as agreed.
4.Creator responsibilities#
- Keep your profile and statistics accurate. Connect only accounts that you own or manage.
- Deliver content as agreed and label it as advertising where the law or the agreement requires.
- Use only content that you own or have permission to use.
- Do not inflate followers, views or engagement, for example by buying them or using bots.
- Give brands accurate payment and tax information. You are responsible for your own taxes unless the law requires the brand paying you to withhold them.
5.Prohibited conduct#
You must not:
- Send spam or unwanted bulk messages, or keep contacting people who opted out.
- Break the terms or policies of any connected platform (such as TikTok, TikTok Shop, Meta or YouTube), including through automated access, scraping or fake activity on accounts connected to BrandMuse.
- Mislead people, hide advertising or make false claims about products.
- Post or send illegal, infringing, hateful, harassing or harmful content.
- Pretend to be someone else or misrepresent your relationship with a brand or creator.
- Collect or reuse other users' personal information outside BrandMuse, or resell data obtained through BrandMuse.
- Interfere with the service, try to get around security or usage limits, or reverse engineer it, except where the law allows.
6.Third-party platforms#
- When you connect a platform such as TikTok Shop, TikTok ads, TikTok, Instagram, Facebook or YouTube, you allow BrandMuse to access the data and take the actions that you approve, within the permissions you grant.
- You must follow the terms and policies of each platform you connect, such as TikTok Shop seller policies, TikTok's business and advertising terms, Meta's platform terms and the YouTube Terms of Service.
- You connect an Instagram business account through Kagit for Business, another service run by WISHNOTE Inc. By connecting, you instruct Kagit to pass the data it receives from Meta for that account to BrandMuse.
- Use data from Instagram only for your brand's work with creators and its ads. Do not sell or license it, or give it to any third party. Do not copy it out of BrandMuse to build other lists or databases. Do not use it in any way that breaks Meta's platform terms or policies.
- Platforms can change or stop their services and APIs. Features that depend on them may change or stop as a result, and we are not responsible for the platforms themselves.
- You can disconnect a platform at any time. Our Privacy Policy explains what happens to the data.
7.Plans, fees and payments#
Plans
- BrandMuse offers a free plan and paid plans. Prices are shown on our pricing page in US dollars and do not include taxes unless stated.
- During the pilot period, we do not charge through BrandMuse. Our team turns on your plan for you.
- Before we start charging for plans, we will tell you the renewal, cancellation and refund terms and ask you to agree to them.
Platform fee
We do not currently charge a platform fee on amounts brands pay creators.
Payments between brands and creators
- Brands pay creators directly. BrandMuse does not process payments, and it does not hold or send money.
- The brand and the creator agree on the amount, date and method. BrandMuse only stores the records they enter.
- A record in BrandMuse does not prove that money was paid. The brand and the creator are responsible for the actual payment, taxes and any refund.
Cancellations and refunds
- If a collaboration is cancelled, the brand and the creator settle any amount between themselves.
- If a brand and a creator disagree, they resolve it between themselves. We do not decide disputes or hold money.
8.Content and rights#
- You keep ownership of the content you add to BrandMuse.
- You give us a worldwide, non-exclusive, royalty-free license to host, copy, process, translate, display and send your content only as needed to run and improve BrandMuse. This license ends when your content is deleted, except for copies that the law requires us to keep.
- Usage rights between a brand and a creator (such as reposting, ad use, period and territory) are those agreed in their collaboration contract.
- BrandMuse, its software, design and trademarks belong to WISHNOTE. You may not copy or use them except as these Terms allow.
- If you send us feedback, we may use it without any obligation to you.
9.AI and automation#
BrandMuse uses AI to score creators, draft offers and messages, sort replies and check content. AI output can be wrong, so review it before you rely on it. You choose manual, assisted or automatic mode for each step; in automatic mode, BrandMuse acts within the limits you set, and you are responsible for those settings. We keep a record of each automatic decision and its reasons.
10.Disclaimers#
BrandMuse is provided "as is" and "as available". To the extent the law allows, we do not guarantee campaign results, sales, the accuracy of third-party or estimated data (such as follower counts or audience estimates), or that the service will be uninterrupted or error-free. Ad disclosure checks and contract templates are tools, not legal advice.
11.Limitation of liability#
- To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data.
- Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim, or USD 100 if you paid nothing.
- These limits do not apply to damage caused by our intentional misconduct or gross negligence, or where the law does not allow them.
- You will compensate WISHNOTE for claims and losses caused by your content, your collaborations or your breach of these Terms.
12.Suspension and termination#
- You can stop using BrandMuse at any time and ask us to delete your account by emailing [email protected].
- We may suspend or close an account that breaks these Terms or the law, puts other users or platforms at risk, or that we are required to close. Where possible, we will tell you the reason in advance and give you a chance to respond.
- When an account is closed, access ends. Amounts agreed between a brand and a creator remain theirs to settle, and data is handled as described in our Privacy Policy.
13.Changes to the service and these Terms#
We may update these Terms. We will post the changes at least 7 days before they take effect, or at least 30 days before for changes that are unfavorable to you, and notify account holders by email or in the app. If you do not agree, you can stop using BrandMuse and close your account. If you keep using it after the changes take effect, the new Terms apply.
14.Governing law and disputes#
These Terms are governed by the laws of the Republic of Korea. The Seoul Central District Court has exclusive jurisdiction over disputes as the court of first instance. If you are a consumer, you also keep any protections that the mandatory laws of your country give you.
15.General#
- If any part of these Terms cannot be enforced, the rest still applies.
- Not enforcing a right at one time does not mean we give it up.
- You may not transfer your rights under these Terms without our consent. We may transfer ours as part of a merger, acquisition or sale of assets.
- These Terms are available in Korean, English and Japanese. If the versions differ, the Korean version prevails.
- We send notices by email to the address on your account or in the app.
